1. Definitions

In these Terms and Conditions, the following words shall have the meanings set out below:

"Vishvam" / "We" / "Us" / "Our" refers to Vishvam, a sole proprietorship owned and operated by Raj Kumari Chomal, based in Delhi NCR, India.
"Website" refers to www.vishvamexports.com and all its pages, subdomains, and content.
"User" / "You" / "Your" refers to any individual who accesses, browses, or uses this Website or avails any Service.
"Services" refers to all healing sessions, consultations, programmes, workshops, memberships, and digital or physical products offered by Vishvam.
"Session" refers to any individual or group healing appointment, consultation, or coaching session booked through the Website or directly.
"Products" refers to physical products (crystals, stones, and related items) and digital products (guides, reports, e-books) sold through the Website.
"Content" refers to all text, images, logos, videos, audio, and other material published on the Website.
"Applicable Law" refers to all laws, regulations, and guidelines applicable in India, including but not limited to the Information Technology Act 2000, the Consumer Protection Act 2019, and the Indian Contract Act 1872.

By accessing or using this Website, booking any Service, or purchasing any Product, you confirm that:

You are at least 18 years of age or are accessing this Website under the supervision of a parent or legal guardian.
You have read, understood, and agree to be legally bound by these Terms and Conditions.

Vishvam reserves the right to modify these Terms at any time without prior notice. Continued use of the Website after any modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

3. Nature of Services — Important Disclaimer

PLEASE READ THIS SECTION CAREFULLY. It contains critical information about the nature of the services offered by Vishvam and the limits of their application.

3.1 Holistic & Complementary Services

All services offered by Vishvam — including Reiki healing, energy healing, crystal healing, Yantra healing, numerology, tarot and divine card readings, hypnotherapy, NLP, and parenting coaching — are holistic, complementary, and spiritual in nature.

These services are NOT a substitute for professional medical treatment, psychiatric care, psychological therapy, legal advice, or financial guidance. Vishvam does not diagnose, treat, cure, or prevent any medical or psychiatric condition.

3.2 Counselling & Psychological Support

While Rajkumari Chomal holds extensive experience as a practising psychologist of 26+ years, services offered through Vishvam are provided in a holistic wellness capacity. Sessions are not formal clinical psychotherapy or regulated medical treatment under the Mental Healthcare Act 2017 or the Rehabilitation Council of India Act 1992.

Users experiencing a mental health crisis, suicidal ideation, or severe psychiatric symptoms are strongly advised to seek immediate professional medical help.

3.3 No Guaranteed Outcomes

Vishvam makes no warranties, representations, or guarantees — express or implied — regarding specific outcomes, results, healing, recovery, or transformation from any Service. Results vary between individuals and depend on numerous factors beyond Vishvam's control.

Any testimonials, case studies, or examples shared on this Website represent individual experiences and are not indicative of results any specific user may achieve.

3.4 User Responsibility

By booking and availing any Service, you acknowledge and accept full personal responsibility for your decisions, actions, and wellbeing before, during, and after any session or purchase. Vishvam shall not be liable for any decisions made by a user based on information received during a session.

4. Booking, Appointments & Sessions

4.1 Booking Confirmation

All session bookings are confirmed only upon receipt of full or advance payment as applicable and a written or electronic confirmation from Vishvam. A booking request does not constitute a confirmed appointment.

4.2 Punctuality

Sessions begin at the scheduled time. If a user is late, the session will still end at the originally scheduled time, and the full session fee will be charged. No extension will be provided for user lateness.

4.3 Cancellation by User

The following cancellation policy applies to all session bookings:

Cancellation made 48 hours or more before the scheduled session: Full refund or free rescheduling, at Vishvam's discretion.
Cancellation made between 24 and 48 hours before the session: 50% of the session fee will be forfeited.
Cancellation made less than 24 hours before the session or no-show: 100% of the session fee will be forfeited. No refund or rescheduling will be provided.
One-time packs (Pratham and Kavach plans): Non-refundable once a session has been booked or confirmed.

4.4 Cancellation by Vishvam

Vishvam reserves the right to cancel or reschedule any session at any time due to circumstances beyond its reasonable control, including illness, emergency, technical failure, or force majeure. In such cases, users will be offered a full rescheduling or a complete refund. Vishvam shall not be liable for any other loss or inconvenience arising from such cancellation.

4.5 Rescheduling

Rescheduling requests must be made at least 24 hours prior to the scheduled session. Each booking may be rescheduled a maximum of two (2) times. Further rescheduling requests may be declined or charged at Vishvam's discretion.

4.6 Distance / Online Sessions

For online sessions, the user is responsible for ensuring a stable internet connection, appropriate privacy, and a quiet environment. Vishvam shall not be liable for any disruption caused by poor connectivity or technical issues on the user's end. If a session is disrupted due to Vishvam's technical failure, a replacement session or partial refund will be offered.

5. Payments, Pricing & Billing

5.1 Pricing

All prices displayed on the Website are in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated. Vishvam reserves the right to change prices at any time without prior notice. The price applicable to your booking or purchase will be the price displayed at the time of transaction confirmation.

5.2 Payment Methods

Vishvam accepts payments via the online payment gateway integrated into the Website. All transactions are processed through secure, third-party payment processors. By making a payment, you agree to the terms of the respective payment processor.

5.3 Recurring Subscriptions

For subscription-based plans (Sadhana, Uday, Pragati, Moksha), the following terms apply:

Subscription fees will be charged automatically at the beginning of each billing cycle (monthly, quarterly, half-yearly, or yearly as applicable).
You authorise Vishvam to charge your payment method on a recurring basis until the subscription is cancelled.
Vishvam reserves the right to change subscription pricing with 30 days' prior written notice to the registered email address.
Sessions under a subscription plan are non-transferable, non-rollover (unused sessions do not carry forward), and cannot be exchanged for cash.

5.4 Setup Fees

Certain plans include a one-time, non-refundable setup or assessment fee. This fee is clearly indicated at the time of purchase and is charged separately from the recurring subscription fee.

5.5 Failed Payments

If a recurring payment fails, Vishvam will attempt to process the payment again. If payment is not received within 7 days of the due date, access to subscription services may be suspended until outstanding dues are cleared.

5.6 GST & Taxes

Vishvam operates as a sole proprietorship. Applicable Goods and Services Tax (GST) or any other statutory tax, if applicable, will be charged in addition to the service or product price as required under Indian law.

6. Refund & Cancellation Policy

This refund policy is governed by the Consumer Protection Act 2019 and the Consumer Protection (E-Commerce) Rules 2020.

6.1 Sessions & Consultations

Refunds for session bookings are governed by the cancellation policy in Section 4.3 above. Once a session has been conducted, no refund will be issued regardless of the user's satisfaction with the outcome.

6.2 Physical Products (Crystals & Stones)

Physical products may be returned within 7 days of delivery if:

The product received is damaged or defective upon delivery (photographic evidence required within 24 hours of receipt).
The product received is materially different from what was described on the Website.

No return or refund will be accepted for:

Change of mind after purchase.
Products that have been used, worn, or energetically cleansed by the user.
Products where the original packaging has been damaged or discarded.

Return shipping costs shall be borne by the user unless the product is defective due to Vishvam's error. Refunds for approved returns will be processed within 14 working days of receipt and inspection of the returned product.

6.3 Digital Products

All digital products — including healing guides, numerology reports, and digital downloads — are non-refundable once accessed, downloaded, or delivered to the user's registered email address. This is consistent with Section 18(4) of the Consumer Protection Act 2019, which excludes digital goods from the return policy once accessed.

6.4 Subscription Plans

Subscription fees paid for the current billing cycle are non-refundable upon cancellation. Cancellation will take effect at the end of the current billing period, and the user will retain access to services until that date. No pro-rata refunds will be issued for partially used billing periods.

6.5 Refund Processing

All approved refunds will be credited to the original payment method within 14 working days. Vishvam shall not be responsible for delays caused by the user's bank or payment processor.

7. Intellectual Property

7.1 Ownership

All content on this Website — including but not limited to text, images, graphics, logos, video and audio content, healing guides, reports, session materials, and the Vishvam brand identity — is the exclusive intellectual property of Vishvam / Rajkumari Chomal and is protected under the Copyright Act 1957 of India and applicable international intellectual property laws.

7.2 Restrictions

You may not, without prior written permission from Vishvam:

Copy, reproduce, republish, distribute, transmit, or sell any content from this Website.
Use the Vishvam name, logo, or brand materials for any commercial or personal purpose.
Record, transcribe, or share any session content, session notes, or materials provided during a session.
Create derivative works based on Vishvam's healing materials, programmes, or methodologies.

7.3 User-Generated Content

By submitting any content to Vishvam (including form submissions, testimonials, or feedback), you grant Vishvam a royalty-free, perpetual, non-exclusive licence to use, display, and reproduce such content for business and marketing purposes, including on the Website and social media platforms.

8. Privacy, Confidentiality & Data Protection

8.1 Privacy Policy

Vishvam's collection, use, storage, and processing of your personal data is governed by our Privacy Policy, which forms part of these Terms and is available on the Website. By using this Website, you consent to the processing of your personal data as described in the Privacy Policy.

8.2 Compliance with IT Act & DPDP Act

Vishvam is committed to compliance with the Information Technology Act 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules 2011, and the Digital Personal Data Protection Act 2023 (DPDPA) as applicable.

8.3 Confidentiality of Sessions

All information shared by a user during a session is treated as strictly confidential by Vishvam. Session content will not be disclosed to any third party except:

Where required by law, court order, or a competent authority.
Where the user has consented to disclosure in writing.
Where there is an imminent risk of harm to the user or another person, in which case Vishvam may take appropriate action including contacting emergency services.

8.4 User Confidentiality Obligations

Users must not record, share, or publish any part of a session — including audio, video, or written notes — without the express prior written consent of Vishvam. Breach of this obligation may attract legal action.

9. Limitation of Liability

To the fullest extent permitted by Applicable Law:

Vishvam's total liability to you for any claim arising out of or in connection with these Terms, your use of the Website, or any Service or Product, shall not exceed the total amount paid by you to Vishvam in the 30 days immediately preceding the event giving rise to the claim.
Vishvam shall not be liable for any indirect, incidental, consequential, special, or punitive damages — including loss of profits, loss of data, personal injury, emotional distress, or loss of goodwill — whether arising in contract, tort (including negligence), or otherwise, even if Vishvam has been advised of the possibility of such damages.
Vishvam shall not be liable for any harm arising from a user's reliance on information, guidance, or insights received during a session or from the Website, including decisions made in relation to medical, financial, legal, or personal matters.
Vishvam shall not be liable for delays, failures, or disruptions caused by circumstances beyond its reasonable control, including acts of God, government action, internet outages, power failures, natural disasters, or pandemics.

Nothing in these Terms limits or excludes liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded under Applicable Law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Vishvam, Rajkumari Chomal, and any associates, collaborators, or service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

Your use of or access to this Website or any Service.
Your breach of these Terms or any Applicable Law.
Any content you submit, post, or transmit through the Website.
Your violation of any third-party rights, including intellectual property rights.

11. Prohibited Conduct

You agree not to:

13. Governing Law & Dispute Resolution

13.1 Governing Law

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of India. The courts of Delhi shall have exclusive jurisdiction over any dispute arising from these Terms.

13.2 Dispute Resolution — Mediation First

In the event of any dispute, claim, or controversy arising out of or in connection with these Terms, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails within 30 days, the parties agree to attempt mediation before initiating any legal proceedings.

13.4 IT Act Compliance

14. Force Majeure

Vishvam shall not be held liable for any failure or delay in performance of its obligations under these Terms where such failure or delay results from causes beyond its reasonable control, including but not limited to acts of God, fire, flood, earthquake, pandemic, epidemic, war, civil unrest, government orders, internet service outages, or power failure. In such events, Vishvam will notify users as soon as reasonably practicable and make reasonable efforts to fulfil its obligations once the force majeure event ceases.

15. Services for Minors

Certain services — including Reiki for Children and Parenting Coaching — may be offered to or involve minors. Where a service involves a minor (a person below the age of 18), the following conditions apply:

A parent or legal guardian must provide written consent prior to any session involving a minor.
A parent or legal guardian must be present during any in-person session involving a minor below the age of 14.
All personal data of minors is processed in accordance with the Digital Personal Data Protection Act 2023 and parental consent requirements thereunder.
Vishvam will not knowingly collect personal data from minors without verified parental consent.

16. Amendments to Terms

Vishvam reserves the right to update, modify, or replace these Terms at any time. The most current version of these Terms will always be available on the Website with the effective date noted at the top. Where changes are material, Vishvam will provide notice via the Website or by email to registered users. Your continued use of the Website or Services after such notice constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason under Applicable Law, that provision shall be deemed severable from the remaining Terms and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and any other policies published on this Website, constitute the entire agreement between you and Vishvam with respect to the subject matter herein and supersede all prior agreements, representations, and understandings.

19. Waiver

No failure or delay by Vishvam in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof. No single or partial exercise of any right or remedy shall preclude any other or further exercise of such right or remedy.
