Customs & Duties Policy

Overview & Legal Framework:

Vishvam Exports conducts international shipments in compliance with Indian export and customs law. Our export operations follow the statutory framework administered by the Central Board of Indirect Taxes & Customs (CBIC) and the Directorate General of Foreign Trade (DGFT) under the Foreign Trade Policy (FTP) 2023. Export consignments leave India only with the required documentation and clearances.

Importer / Buyer Responsibility (Key point):

  • confirming that Pranava Spices products are permitted in their country;

  • obtaining any required import licences, permits or approvals; and

  • paying all import duties, value-added taxes, customs clearance fees, and any local charges levied by the destination country.

Vishvam Exports will provide required export documentation (commercial invoice, packing list, Certificate of Origin where applicable), but the importer is responsible for timely customs clearance and compliance with local rules.

Duties, Taxes & Customs Valuation:

  • Customs duties and taxes are calculated by the importing country’s customs authority based on their tariff schedules, HS codes and customs valuation rules. Vishvam Exports does not set or collect foreign customs duty — these amounts, if any, are collected by the destination country’s customs broker or authority at import.

  • For domestic compliance, applicable Indian duties, cess, GST, or exemptions are applied as per CBIC and GST rules at the time of export.

Incoterms, Risk & Transfer of Ownership:

  • All international sales will quote and follow the agreed Incoterms® 2020 rule (for example: FOB, CIF, EXW). The chosen Incoterm determines which party is responsible for costs, insurance and risk at each stage. Unless otherwise agreed in writing, risk and ownership pass to the buyer as per the selected Incoterm. We recommend buyers confirm Incoterms in the sales contract.

Customs Documentation & Certificates:

Vishvam Exports will provide standard export documents such as: commercial invoice, packing list, shipping bill / bill of export, and Certificate of Origin (as needed). Additional documentation (phytosanitary certificates, phytosanitary/health certificates, HACCP, organic or ISO certificates) can be provided on request subject to availability and cost. Export documentation will be prepared as required under FTP and FSSAI guidance for spices.

Customs Delays, Seizure & Non-Compliance:

  • If customs in the destination country holds, inspects, fines, or seizes goods for non-compliance with local rules, the importer/buyer bears responsibility for any costs, fines, penalties or additional storage/clearance charges.

  • Vishvam Exports will cooperate with the buyer and the customs agent, but we are not liable for customs actions, delays, or penalties imposed by foreign authorities.

Returns, Refunds & Dispute Scenarios (Export):

  • Once goods are exported and cleared by Indian customs, refunds or replacements for customs-related rejections are not guaranteed. Any return shipment, re-export, or destruction ordered by foreign customs is the buyer’s responsibility and cost, unless otherwise agreed in writing.

  • If Vishvam Exports is at fault (incorrect product sent, or proven pre-dispatch defect), we will work with the buyer to arrange remediation as per our Returns & Refund Policy and applicable export controls.

Prohibited & Restricted Shipments: 

Vishvam Exports will not ship to destinations or entities that violate Indian export controls, UN/UNSC sanctions, or other international embargoes. We reserve the right to cancel or refuse an order if export would contravene applicable Indian or international law.

HS Codes, Tariff Classification & Customs Advice (Buyer to Verify):

We can provide HS (Harmonized System) codes for our products on request. HS codes and tariff classification used by customs authorities may differ across countries; importers should verify tariff classification and applicable duties with their customs broker before ordering.

Insurance Recommendation:

We strongly recommend buyers arrange marine or cargo insurance (as applicable under the agreed Incoterm) to protect against loss or damage in transit. If seller-arranged insurance is part of the agreement (e.g., CIF), the buyer should confirm the policy scope and claims process prior to shipment.

Compliance & Quality Standards (Food Exports):

Our spice exports follow FSSAI standards, Spices Board guidance and applicable food-safety norms. Buyers requiring additional certificates (e.g., phytosanitary, HACCP, organic certification) should request these at order confirmation; additional fees or lead times may apply.

Governing Law & Dispute Resolution:

Export transactions and disputes are governed by the laws of India. Where feasible, parties are encouraged to resolve disputes amicably; otherwise disputes will be referred to the courts in Faridabad, Haryana, or arbitration in India as per the parties’ agreement.
